Limited Use License Agreement

Image License

Image rights sold on this site constitute a license and not a sale.  This license grants you (the "Licensee") the right to use images (the "Image") under the following terms:

1. Scope of Use:
   • The Licensee may use the Image solely within their business operations.
   • Permitted uses include website content, marketing materials, presentations, and internal communications.
2. Restrictions:
   • The Licensee may not resell, sublicense, transfer or distribute the Image to third parties.
   • The Image may not be used outside the Licensee's business context.
3. Attribution:
   • While not required, giving credit to the creator (EricNewlon.com) is appreciated.
4. Duration:
   • This license is perpetual unless terminated by either party.
5. Disclaimer:
   • The Image is provided "as is." The Licensor makes no warranties regarding its fitness for a specific purpose.

Audio Licensing: What Commercial Use Means

Rights Granted

When a client pays for a license, they are granted specific rights to use the music in various commercial contexts. This can include:

• Broadcasting: Using the music in advertisements, radio spots, or television commercials.
• Public Performance: Playing the music at events, in stores, or in any public setting.
• Digital Distribution: Using the music in online content, such as videos on platforms like YouTube, social media, or podcasts.

Exclusivity

Depending on the terms of the license, the client may receive exclusive rights to the music, meaning that the composer will not sell or license the same piece to other clients. Alternatively, the license may be non-exclusive, allowing the composer to sell the same music to multiple clients.

Duration and Territory

The license may specify how long the client can use the music and in which geographical areas. For example, the license might be valid for a specific number of years or for use in certain countries.

Additional Fees

If the client wants to use the music in a way that goes beyond the initial licensing agreement (e.g., for a different type of project, in a different territory, or for a longer duration), additional fees may apply.

Licensing helps protect both the composer and the client legally. The composer retains ownership of the music while allowing the client to use it under agreed-upon terms, reducing the risk of copyright infringement.
